Fourth Interim Application for Compensation of Attorneys Fees and Costs of Martin Mann, QC as British Virgin Islands Law Expert for the Receivership Entities

On July 8, 2003, the Securities and Exchange Commission filed a Complaint for Injunctive and Other Relief (the "SEC Action") against, among other parties, Lancer Management Group, LLC; Lancer Management Group II, LLC; Lancer Offshore, Inc.; Omnifund, Ltd.; LSPV, Inc.; and LSPV, LLC (collectively, the "Receivership Entities") in the United States District Court for the Southern District of Florida (the "District Court"). On July 10, 2003, the District Court appointed Marty Steinberg as the Receiver for the Receivership Entities. Hunton & Williams LLP represents the Receiver. By Order dated September 3, 2003, the District Court expanded the Receivership to include G.H. Associates, LLC and Alpha Omega Group, Inc. as "Receivership Entities."

By Order dated September 30, 2005, the District Court expanded the Receivership to include CLR Associates, LLC as a receivership entity.

On January 8, 2004, the District Court entered the Case Management Order ("CMO") which, among other things, established April 1, 2004 as the deadline for filing all claims and interests with the Receiver (see Announcements below). The CMO (which is available below under Pertinent Pleadings) also established certain notice and procedures for the Receivership. All interested parties should review the CMO carefully.

To assure proper notice under all circumstances, the CMO requires that a request for service of papers in the SEC action (a "Request for Notice") must be served upon the Receiver and filed with the District Court. The request must include: (a) an address at which all documents may be served by U.S. Mail, hand-delivery, overnight delivery and facsimile; (b) the telephone number of each entity requesting service; (c) an e-mail address for service by e-mail if the entity consents to service by e-mail; and (d) the contact information for the entity's lead and local counsel.

Because e-mail provides the fastest and most economical method of service, the Receiver requests that all parties with regular access to e-mail consent to service by e-mail. By indicating your e-mail address in the Request for Notice, you are deemed to have consented to service by e-mail, unless you specify otherwise. Alternatively, if you are willing to accept service (from the Receiver only) by e-mail, you may click here and send the Receiver an e-mail with your name, mailing address, e-mail address and telephone number advising that you consent to service by e-mail.

SPECIAL ANNOUNCEMENT: NOTICE TO INVESTORS FROM THE DEPARTMENT OF JUSTICE - BRUCE COWEN SENTENCING HEARING

The sentencing hearing for Bruce Cowen, a former Lancer associate, was rescheduled for June 14, 2005 at 8:30 a.m. before Judge Cecilia Altonaga of the United States District Court for the Southern District of Florida, Miami Division. Judge Altonaga's courtroom is located on the fourth floor of the United States Courthouse at 310 North Miami Avenue, Miami, Florida 33132. 3/17/04	The Lancer Partners LP bankruptcy case has been transferred to the United States District Court for the Southern District of Florida before Chief Judge William J. Zloch, who is presiding over the receivership case. 4/1/04	The District Court has established April 1, 2004 as the deadline for filing all claims or interests in or against the Receivership Entities. All investors and creditors of any of the Receivership Entities who wish to receive a distribution from the receivership estate must file a claim with the Receiver on or before April 1, 2004. Failure to timely submit your claim may result in the disallowance of your claim entirely. 10/20/10	Michael Lauer's Emergency Motion for court to stay its order granting receiver's motion authorizing first interim distribution of estate assets pending outcome of appeal (DE 2413) As many of you are aware on October 20, 2010, Michael Lauer filed an Emergency Motion to Stay Order Granting Receiver's Motion Authorizing First Interim Distribution of Estate Assets Pending Outcome of Appeal (the "Emergency Motion"), requesting the United States District Court for the Southern District of Florida (the "District Court"), that is presiding over the Lancer Offshore and Omnifund receivership cases to stop the Receiver's anticipated distribution of $32,000,000 to investors pending a final adjudication of his appeal of the District Court's September 22, 2008 Order and Opinion on Motion for Summary Judgment in favor of the SEC. The District Court denied only that portion of Mr. Lauer's motion seeking emergency relief. In denying the emergency relief, the Court stated that it would consider the substantive portion of the Emergency Motion in the normal cycle for pending motions in the Lancer cases. The Receiver filed a written response on November 4, 2010 objecting to the stay so he can distribute the funds expeditiously. In the interim, the Receiver has decided not to make the distribution until the Court adjudicates the Emergency Motion.
